Agreement to Terms

These Terms and Conditions (“Terms”) govern your use of exceleyecenter.com (the “Site”), operated by Excel Eye Center, with eye care and cosmetic surgery locations across Utah County and central Utah.It is designed to help patients and visitors learn about our physicians, eye care services, cosmetic, services, locations, and other resources as well as conveniently request appointments and access online services and information. By accessing or using this Site, you agree to these Terms. Certain services available through or linked from the Site, including Patient Portal and payment services, may also be subject to separate terms and privacy practices. If you do not agree with these Terms, please discontinue use of the Site.

Health and Medical Information

Information on this Site is to help patients better understand eye conditions, treatment options, our physicians, and the service available at Excel Eye Center. 

Because every patient’s health and circumstances are different, information on this Site is education and cannot replace examination, diagnosis, or treatment recommendations form a qualified healthcare provider. 

Browsing the Site or submitting a general contact or appointment request does not, by itself, establish a doctor-patient relationship. Communication through our Patient Portal may be used as part of an existing patient’s care. 

If you have a medical concern, please contact our office directly at (801) 374-1818. If you are experiencing a medical emergency, call 911 or seek immediate emergency medical care. The Site, appointment request forms, and Patient Portal should not be used for emergency communications.

Use of This Website

You agree to use this Site only for lawful purposes and in a manner that does not interfere with the Site, our systems, or the rights of others. Attempting to gain unauthorized access to our systems, knowingly submitting false or harmful information, uploading malicious software or improperly scraping of harvesting Site content are prohibited activities.

Appointment Requests and the Patient Portal

Appointment request forms submitted through this Site are requests only. An appointment is confirmed once  it has been finalized by our team or through an authorized scheduling or communication service, such as Luma. You may receive appointment confirmations, reminders, or other scheduling communications through Luma or another service used by Excel Eye Center. Occasionally, provider availability, scheduling needs, or clinical circumstances may require use to suggest a different appointment time or provider.

We reserve the right to reschedule or decline appointment requests. If you use our Patient Portal, you are responsible for keeping your login credentials confidential and for all activity under your account. Please contact our office immediately if you suspect unauthorized access to your account.

Payments and Gift Cards

Online payments and gift card purchases made through this Site are processed by third-party payment providers. By making a purchase, you confirm that the payment information you provide is accurate and that you are authorized to use the payment method. Gift cards are subject to any terms presented at the time of purchase. Unless otherwise stated or required by law, gift cards purchases are non-refundable.

Reviews and Testimonials

Every patient is different, and treatment outcomes may vary based on the patient’s conditions, health, treatment plan, healing response, and other factors. Testimonials, review, and before-and-after photographs represent individual experiences and are not intended as a guarantee of any specific result.

 

Intellectual Property

The content that makes up this Site, including text, photographs, graphics, logos, videos, and other materials  on this Site are owned by Excel Eye Center or used with permission and are protected by copyright and other intellectual property laws. You may view and print pages from the Site for your own personal, non-commercial use,unless otherwise permitted by law or approved by Excel Eye Center, Site content may not be reproduced distributed, republished, sold, or used to create derivative works without prior written permission.

This Site may connect to third-party websites, such as our Patient Portal provider, payment processors, or social media pages,or other resources for your convenience. These third parties operate independently and may have their own terms, privacy policies and security practices. Excel Eye Center does not control those third-party services and is not responsible for their content or practices.

 

Disclaimer of Accuracy and Availability

This Site may occasionally contain errors, experience interruptions, or become temporarily unavailable. Information may also change as medicine, technology, providers, services, or our organization evolve. As permitted by law, the Site and its digital content and functionally are provided on an “as is” and “as available” basis. We do not guarantee that every portion of the Site will always be uninterrupted, error-free, or free from harmful technological components.

 

Limitation of Liability

To the fullest extent permitted by law, Excel Eye Center will not be liable for any indirect, incidental, or consequential damages arising out of your use of, or inability to use, this Site or its online functionality. Medical care and treatment provided by Excel Eye Center physicians and staff are separate from the general operation of this website and are governed by applicable law, professional standards of care, and any applicable patient agreements.

Users are responsible for their own use of the Site. you agree to indemnify and hold harmless Excel Eye Center, its physicians, employees, and affiliates from claims or losses resulting form your unlawful misuse of the Site or violation of these Terms.

These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-law principles. Any disputes arising from these Terms or your use of this Site will be resolved in the appropriate state or federal courts located in Utah County, Utah.
